Can you get the return of your engagement ring if the marriage falls through in Virginia? Unfortunately, there is no consensus answer in Virginia.
In 1992, the Retired Honorable Judge McWeeny of the Fairfax County Circuit Court answered this question no. Harrison v. Yarbrough, 1992 WL 8846201 (Fairfax 1992). In 2005, the Honorable Judge Doherty of the Salem County Circuit Court answered this question no. Holmburg v. Ferrell, 69 Va. Cir. 348 (Salem 2005). In 2006, the Honorable Judge Fisher of the Newport News Circuit Court answered this question no. Goergalas v. Kilgore, 73 Va. Cir. 36 (Newport News 2006). And now, in 2014, the Honorable Judge Horne of the Loudoun County Circuit Court has chimed in with his answer: yes, you can get back your engagement ring. Peter v. Langley, Case No. 89241. What a crapshoot!
